2. Website Access
2.1 Break Free Adventours and website users agree that access to the site, viewing, use, or contracting from it is governed by these terms and conditions.
2.2 The use of this portal implies and presupposes that users fully and unreservedly accept all the terms and conditions of the website in the version published and in force at the time users access this portal, especially those established regarding limitation of liability, as well as those of any tourist or travel service provider. Therefore, users should read these terms and conditions carefully before using the portal and expressly declare that they have read and understood them, as they may have been modified since the last time they accessed it.

3.1 Break Free Adventours may implement improvements or changes to the information, elements, data, services, and other elements of this website or cancel it at any time without prior notice.
3.2 Break Free Adventours may also modify these website terms and conditions at any time, and such modification will be valid as long as it is introduced on the website.
3.3 Consequently, access and subsequent use of the website imply the users' approval of the new terms and conditions.

4.2 To the extent legally permitted, under no circumstances shall Break Free Adventours be held liable for any damages, including lost profits and consequential damages, directly or indirectly related to the use or inability to use the content, materials, functions, and information made available through the website www.breakfreeadventours.com, even if Break Free Adventours has been advised of the possibility of such damages.
4.3 To the extent legally permitted, the liability limitation provided in the previous point includes all damages caused to the user's computers resulting from the direct or indirect, incidental, or consequential use of the website www.breakfreeadventours.com, as well as any damages caused by the dissemination of viruses, "trojans," and "worms," regardless of their origin and mode of transmission.

Break Free Adventours is not responsible for the information, addresses, or materials included in those sites.

These links are for informational purposes only, and Break Free Adventours assumes no responsibility for the accuracy, completeness, or legality of the content of these websites or for any information, opinions, product or service offers contained therein. Break Free Adventours declares it has no control regarding confidentiality risks, security, and other aspects over third-party sites.
4.7 The user is responsible, in any case, for the accuracy of the data provided, and Break Free Adventours reserves the right to exclude any user who has provided false data from the registered services, without prejudice to other actions or proceedings that may be pursued in court.
4.8 By sending materials to any of Break Free Adventours' servers by email or through its website pages, the user agrees to the following:
(i) The materials shall not contain any illegal or inappropriate elements for publication;
(ii) The user shall search for and eliminate any viruses or other destructive aspects before submitting any material;
(iii) The user owns the material they submit or has an unlimited right to provide it;
(iv) Break Free Adventours may publish these materials without charge and/or incorporate them or any concepts described therein into its products.
II. CONTRACTED SERVICES
1. General
1.1. The Terms and Conditions detailed herein constitute the entirety of the contract between the client and Break Free Adventours (King’s Travellers Lda.), headquartered at Tv. Picoto nº 19 4800-157 Guimarães, registered at the Porto Commercial Registry with the unique corporate number 514606711 and RNAVT 7494. This contract can only be amended in writing by a representative of Break Free Adventours.
1.2. Break Free Adventours is an agency that organizes trips for clients and is not a carrier, hotel chain, or owner of aircraft or hotels. All bookings with carriers, hotels, and other service providers are subject to the terms, conditions, and liability limits imposed by those carriers, hotel chains, and other service providers with whom Break Free Adventours has partnerships or uses as needed. Please note that some of these conditions may limit or exclude liability in cases of death, bodily injury, delay, and loss or damage of luggage, and therefore, we do not accept any liability for any loss resulting from such actions or from any act or omission by third parties.
1.3. The Terms and Conditions mentioned herein are supplementary to the travel plan in which you enroll.
1.4. By agreeing with Break Free Adventours, you acknowledge and accept all the Terms and Conditions set forth.
2. Insurance and Travel and Tourism Guarantee Fund
Break Free Adventours’ liability is covered by a civil liability insurance policy with Fidelidade Seguros and by the Travel and Tourism Guarantee Fund of Turismo de Portugal, in accordance with current legislation.
3. The Reservation
3.1. To make a reservation, the client must access the contact form available on the website, fill it out completely and as thoroughly as possible, and send it back to Break Free Adventours, which will then follow up on the request. We advise making contact as early as possible to ensure the best possible rates for transportation, accommodations, and related activities.
3.2. After receiving the contact form, Break Free Adventours will contact the client to provide more detailed information regarding the selected trip.
3.3. If the client wishes to customize their trip, after receiving the contact form, Break Free Adventours will respond with additional questions to better understand the client’s goals and budget for the experience/trip.
3.4. For customized trips, Break Free Adventours will proceed with the travel request by developing an initial budgeted itinerary for validation, which may then be modified until it meets the client’s requirements. The client can request up to two modifications to the original itinerary at no additional cost. After this limit, the cost of each modification will be added to the final budget, with a fee of 20 Euros per modification.
3.5. Whether the trip is customized or not, once the client confirms their interest in the trip, they must make bank transfer deposit of 50% of the trip price (if reserved 60+ days in advance) within a maximum of 72 hours to the IBAN of Break Free Adventours. The payment proof must be sent to Break Free Adventours' email info@breakfreeadventours.com, including personal identification and the trip being reserved. If the reservation is made less than 60 days in advance, the total amount must be paid. The reservation process will only begin once the full payment is received. 3.6. If the client cancels the reservation, and the cancellation is not due to non-payment or any other breach of these terms and conditions, the deposit will be retained by us.
3.7. If the full payment is not received within the period established in these terms and conditions, Break Free Adventours reserves the right to apply default fees or treat the reservation as canceled, retaining the deposit as a cancellation fee without issuing any refund
3.8. Upon receipt of the full payment for your reserved trip—subject to availability—Break Free Adventours will reserve your spot on the chosen trip. An agreement is formed between you and Break Free Adventours only after the reservation is confirmed by Break Free Adventours and communicated in writing (email or otherwise). By confirming the reservation, you authorize Break Free Adventours to contact, on your behalf, the entities—providers of goods and services—responsible for the trip. The delivery of the trip will be handled by Break Free Adventours or its partners, including travel agencies, accommodations, carriers, or others, as per the agreements made.
3.9. In the case of a customized trip, all information provided in the email proposal is correct to our knowledge; however, we cannot guarantee the availability of certain items mentioned, particularly if we do not have direct control over them (e.g., third-party suppliers).
3.10. Break Free Adventours commits to providing you with the best travel experience, in line with what we understand to be the best quality in terms of the requested travel plan, including the chosen itinerary, accommodations, transportation, and tours/guides contracted locally.
4. Responsability
4.1. Under no circumstances can Break Free Adventours be held responsible for weather conditions, nor can any experience be canceled or altered by you at any time based on weather conditions.
4.2. Under no circumstances can Break Free Adventours be held liable for any damage/loss of property or injury/death of persons attributed to you for failing to follow safety signs and advice.
4.3. Break Free Adventours advises you to read the experience program carefully, as it will only be responsible for reservations requested through the contact form.

4.5. No refunds will be given if, due to reasons beyond Break Free Adventours' control, such as delays, cancellations, or disruptions related to legislation, regulation, acts or lack thereof, demands, orders, or government interventions, or by Acts of God, strikes, fires, floods, war, rebellion, terrorism, revolutions, diseases, quarantine, epidemics, theft, or any other cause beyond our control, the trip cannot be fulfilled.
4.6. You are responsible for any costs incurred as a result of damage or extra cleaning fees related to your booking, including but not limited to transportation, accommodations, visits, and activities. You are advised to report any pre-existing damage to the venue staff and/or the accompanying leader as soon as you detect it.
4.7. When the traveler occupies a seat in a vehicle equipped with a seatbelt, service providers, operators, agents, or organizations that collaborate cannot be held responsible for any illness, injury, or death, nor for any loss, damage, or claims resulting from any accident or incident if the seatbelt was not being used at the time of the accident.
4.8. Clients are responsible for carrying their luggage to transportation and their rooms. There may be situations where clients will have to carry their luggage over long distances and through areas with obstacles, and no assistance will be provided unless the costs are borne by the client.
5. Price
5.1. Prices are always set in Euros.
If, after confirming your reservation, you wish to make any changes, you may do so subject to availability, provided that the date is listed on our website and/or social media, and the change is requested within 60 days before the tour starts.Otherwise, the client's cancellation conditions will apply. A fee of 25 Euros per person per alteration will be applied (plus any charges imposed by accommodations, tour agencies, or transportation providers).
5.3. Modifications to additional services (transfers, pre- and post-Tour accommodations, upgrades, additional activities) will incur a cost of 20 Euros per person per service, plus any fees that may be charged by accommodations, transportation providers, and tour agencies.
5.4. The prices listed in the program are based on the costs of services and exchange rates in effect at the time of printing of the program, and are therefore subject to change (increase or decrease) resulting from variations in the cost of transportation, fuel, and other energy sources, taxes, or fees levied on travel services included, applied by third parties not directly involved in the execution of the organized trip, including accommodation taxes, as well as exchange rates, up to 20 days before the travel date.
5.5. If the increase exceeds 8% of the total price of the organized trip, the provisions of section 9 will apply. In the event of a price reduction, the travel and tourism agency reserves the right to deduct from the refund to the traveler the corresponding administrative expenses, which will be justified upon request by the traveler.
5.6. Unless otherwise indicated in the program, the price does not include: flights to and from your destination, airport taxes, passport and visa fees, laundry services, personal transportation, local guides not mentioned in the program, telephone calls, beverages, meals not detailed in the itineraries, tips, personal items, excess baggage, and optional excursions.
6. Payment Method. Bookings and Refunds
6.1. At the time of pre-booking (if this occurs more than 60 days before the start date of the Tour), Break Free Adventours requires a transfer of 50% of the total trip cost, issuing the corresponding receipt specifying, in addition to the amount paid in advance by the traveler, the organized trip requested. The remaining balance must be paid up to 60 days before the start of the Tour. Reservations are subject to confirmation of all services by the suppliers.
6.2. Failure to pay the total trip cost under the specified conditions may result in the trip being canceled, with the conditions outlined in section 7 being applied.
6.3. If, before the trip begins, Break Free Adventours is unable to provide any of the services requested by the client (including the price as outlined above—an increase of more than 8%), this will be communicated to the traveler by Break Free Adventours, and the traveler may cancel the reservation, receiving a refund of the amounts paid in advance, if applicable.
6.4. All refunds will be processed exclusively through Break Free Adventours, and no refunds will be made for services voluntarily not used by the traveler.
6.5. Payments must always be made in Euros.
7. Cancellation by the traveller
7.1. The traveler may cancel the requested or contracted services at any time, with the right to a refund under the following conditions:
a) If canceled 60 days before the start of the Tour, Break Free Adventours will retain 50% of the deposit as service fees. Any amount paid beyond the deposit will be fully refundable (after deducting any non-recoverable costs).
b) If canceled between 31 and 59 days before the start of the Tour, Break Free Adventours will retain 100% of the deposit plus 50% of the amount already paid (after deducting any non-recoverable costs).
c) If canceled 30 days or less before the start of the Tour, Break Free Adventours will retain the total amount already paid.
7.2. Cancellation of additional services such as transfers, Pre- and Post-Tour accommodations, upgrades, and additional activities booked directly with Break Free:
a) Third-Parties, subcontractors or partners' Terms & Conditions apply

7.3. If applicable, the traveler will be refunded the difference between the amount paid and the amounts referred to above. In this case, the refund will be made, minus the cancellation fee, within a maximum period of 14 days after the termination of the travel contract.
7.4. Once the trip has started, no refund is due for services not used by the traveler due to force majeure or reasons attributable to the traveler, except for refunds from the respective providers. If the services provided in the travel program are not delivered due to reasons attributable to Break Free Adventours and it is not possible to substitute them with equivalent services, the traveler is entitled to a refund of the difference between the price of the planned services and those actually provided.
7.5. In exceptional situations, the additional cost of any modification will be covered by the client. Break Free Adventours is not responsible for any incidental costs that may arise from itinerary changes, such as visas, vaccinations, flights, accommodations, among others.
7.6. Force majeure is defined as any natural or human event that, although foreseeable or even preventable, could not be avoided, either in itself or in its consequences, including but not limited to war, hostile or guerrilla acts, attacks, uprisings, riots or military or civil insurrections, quarantine restrictions, epidemics, strikes, labor disturbances of any kind, restrictions or detention/seizure of goods or persons imposed by any public or governmental authority, adverse weather conditions (specifically dry fog), natural disasters, public enemies, absence of necessary governmental authorizations, or due to any other cause of this nature or another, beyond the control of Break Free Adventours.
7.7. The traveler also has the right to terminate the travel contract before the trip begins without paying any termination fee if unavoidable and extraordinary circumstances occur at the destination or its immediate proximity that significantly affect the execution of the trip or the transportation of passengers to the destination. Termination of the travel contract in this situation only entitles the traveler to a full refund of the payments made.
8. Re- Assignment of Contractual Position
8.1. The traveler may transfer their reservation to another person who meets all the required conditions for the organized trip, provided they inform Break Free Adventours in writing at least seven days before the scheduled departure date.
8.2. The assignor and the assignee are jointly liable for the payment of any outstanding balance and for any fees, charges, or additional costs resulting from the assignment, which will be duly informed and documented by the travel agency.
9. Changes Made by Break Free Adventours
9.1. Break Free Adventours commits to providing its clients with all the contracted services listed in the program/offer (promotion) that formed the basis of the organized travel contract. However, if before the start of the organized trip: (i) Break Free Adventours is forced to significantly alter any of the main characteristics of the travel services, (ii) is unable to meet the traveler’s special requests, (iii) or proposes an increase in the trip price by more than 8%, the traveler may:
a) Unless otherwise agreed between the parties, choose between terminating the contract without any penalty or accepting a modification of the contract specifying the changes made and their impact on the price, or accepting a substitute organized trip offered.
b) If the traveler chooses to terminate the contract as provided, or if Break Free Adventours cancels the organized trip before the agreed departure date for any reason not attributable to the traveler, they will be entitled, from the moment the contract is terminated, to a refund of all amounts paid, or to take another organized trip of equivalent or superior quality, provided that Break Free Adventours can offer it. If the offered trip is of lower quality, Break Free Adventours must refund the traveler, where applicable, based on the amounts already paid, the price difference related to the contract.
9.2. The traveler must communicate their decision to Break Free Adventours within seven following days of being notified of the modification referred to in items (i) to (iii). If the traveler does not notify their decision within the indicated terms, it will be understood that they tacitly accept the proposed conditions.
10. Termination of the Contract by Break Free Adventours
10.10.1. When the trip depends on a minimum number of participants, Break Free Adventours reserves the right to cancel the organized trip if the number of participants is below the minimum. In such cases, the traveler will be informed in writing of the cancellation within:
a) 20 or more days before the start of the organized trip for trips longer than six days;
b) 7 or more days before the start of the organized trip for trips lasting two to five days;
c) 48 hours before the start of the organized trip for trips lasting less than two days.
10.2. If the Tour is canceled by Break Free Adventours for reasons other than Force Majeure, you may choose one of the following options:
a) Substitution of the Tour with another of equivalent or superior value;
b) Substitution of the Tour with another Tour of lower value if no equivalent or superior option is available, with a refund of the price difference;
c) Full refund of the amount paid for the Tour, except for non-recoverable costs.
10.3. Break Free Adventours reserves the right to issue a full refund of the Tour value instead of the options presented if it deems appropriate.
10.4. Before the start of the organized trip, the travel agency may also terminate the contract if it is prevented from fulfilling it due to unavoidable and extraordinary circumstances, which are considered to be external, abnormal, and unforeseeable, and whose consequences could not have been avoided even with due diligence.
10.5. Termination of the travel contract by the agency as referred to above only entitles the traveler to a full refund of payments made within a maximum of 14 days after the termination of the travel contract, with no obligation to compensate.
10.6. Break Free Adventours is not responsible for any expenses arising from the Tour reservation, including but not limited to visas, vaccinations, non-refundable transportation tickets, parking fees, or any other expenses, loss of wages, or loss of vacation time.
11. Extra Services
11.1. Extra services refer to any activities, transportation, meals, products, or services not expressly included in the itinerary or the Tour price and do not form part of the original Tour.
11.2. The traveller agrees that any assistance provided by Break Free Adventours representatives in organizing, selecting, or booking any Optional Services is purely at the traveller's request, and Break Free Adventours offers no warranties and expressly disclaims any liability arising from participation in Extra Services or any information provided by any Break Free Adventours representative regarding any extra services.
11.3. The traveller releases Break Free Adventours from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or harm related to or resulting from the participation or booking of extra services.
11.4. The traveller acknowledges and agrees that any liability for loss, damage, death, personal injury, illness, emotional distress, mental suffering, psychological injury, or loss or damage to property associated with extra services is the sole responsibility of the partner providing that service or activity.
12. Complaints
12.1. Any non-compliance in the performance of a travel service included in the organized travel contract must be communicated to Break Free Adventours in writing or by other appropriate means as soon as such non-compliance occurs, i.e., without undue delay.
12.2. The right to submit complaints for the purpose of a price reduction or the right to compensation for non-compliance with the travel services included in the organized trip expires within 2 years.
13. Information to be Provided to the Traveler
13.1. We inform the traveler that at the time of signing the contract, they should receive from Break Free Adventours information regarding the specific documentation required for the chosen trip and information on the probable risks implicit in the destination and contracted trip, in compliance with the General Law of Traveler Protection. For these purposes, however, we recommend that the traveler contact the Ministry of Foreign Affairs, whose information desk provides specific recommendations according to the destination via the Internet (http://www.minnestrangeiros.pt/mne/) or by any other means.
14. Travel Insurance
14.1. Travel insurance is mandatory for all our foreign travellers and must be presented at the time of booking. Travel insurance must include personal accident, death, medical expenses, and emergency repatriation with a minimum coverage of €200,000 for each category.
14.2. Break Free Adventours also recommends that travel insurance coverage extends to cancellations, limitations, liability, and loss of baggage or personal belongings. The traveller must provide the insurance policy and the 24-hour emergency contact number of the insurance company on the first day of the Tour. The traveller will be prevented from participating in the Tour without providing these details.
14.3. If the travel insurance is associated with the traveller's credit card, the traveller must ensure they have all the details of the insurance company, the policy, and the 24-hour emergency number, and not just the name of the bank and bank details.
14.4. The traveller acknowledges that travel insurance is not included in the Tour price and that they are required to purchase such insurance at an additional cost.
15. Images & Marketing
15.1. The traveller agrees that while participating in any Tour, images, photos, or videos may be taken by other participants, Break Free Adventours, or its representatives or partners, and that these may contain or highlight the client. The client consents to such actions and grants a perpetual, royalty-free, worldwide, and irrevocable license to Break Free Adventours, its contractors, subcontractors, and partners to reproduce for any purpose (including marketing, promotions, and the creation of promotional materials by or with partners), in any media, whether at the time or in the future, without any further obligation or compensation to be paid to the client.
16. Changes to Terms and Conditions
16.1. Break Free Adventours reserves the right to update or amend these terms and conditions at any time and will publish the changes on its website.
16.2. Any changes will take effect 10 days after being posted on the Break Free Adventours website.
16.3. An updated copy of the terms and conditions can be viewed at any time on the said website and will be sent to the client upon written request to Break Free Adventours.
16.4. The traveller is deemed to have accepted any changes to these terms and conditions if, within 10 days of their publication on the Break Free Adventours website, the client does not make any written complaint.
16.5. Break Free Adventours recommends that the traveller reviews the terms and conditions before traveling to familiarize themselves with the most up-to-date version available.
